Search and Seizure
At the Law Firm of Leslie Legal Group, Attorney at Law, the experienced criminal defense attorneys are well versed in "search & seizure" law and have had numerous cases dismissed as a result of a trial court judge granting our motion to suppress evidence.
In my almost two decades of criminal defense practice, I have learned to read between the written lines of the police reports to find that the arresting officer actually violated my client's right to be free from an unreasonable search & seizure. Proudly, the Fourth Amendment to the United States Constitution protects us as citizens from unlawful and unjustified searches & seizures. Usually, most seizures of this type occur without a court authorized warrant!
Penal Code section 1538.5 is the vehicle that allows an experienced criminal defense attorney to request the court for an order to suppress any and all tangible or intangible evidence obtained as a result of an unlawful search & seizure.
Simply, local, State and or Federal law enforcement officers are not allowed to detain, arrest or conduct a search & seizure of your body (pockets), personal belongings (purse), home or vehicle unless they have "probable cause" or a warrant issued by the court specifically detailing what can and cannot be searched.
If you have been arrested after a cop searched your home, body, vehicle or property, then it is imperative to call a knowledgeable and experienced San Diego criminal defense attorney immediately! My firm will thoroughly examine the police reports in your case and commence an investigation surrounding your arrest and search & seizure. I will argue to the court to suppress the evidence (drugs, blood sample) seized during your contact with law enforcement if I believe they acted illegally or without a court warrant.
Remember, your Constitutional Rights should never be violated and should always be protected! ("We The People!") Please read my "People's Rights" page! Me and the lawyers in my law firm, as highly skilled San Diego criminal defense attorneys, will always stand up and fight for your rights.
We will not tolerate government officials who do not follow the law (State & Federal Constitutions) and who believe that the end result justifies the means! Again, we are thoroughly committed to protect your constitutional rights, fight your charges and due what is legally necessary to win your case.Call My Law Firm to Speak with a Criminal Lawyer Not a Case Manager or Paralegal
