Felony DUI

Pursuant to the California Vehicle Code (CVC) and the California Penal Code (CPC) felony DUI charges may stem from driving under the influence of alcohol or drugs and causing injury to another person (CVC 23153) and driving under the influence of alcohol or drugs and killing another person which can be alleged as second degree murder or vehicular manslaughter (CPC 187, 192 et seq.).
Other circumstances or crimes that may result in felony charges stemming from a DUI arrest may include hit & run causing injury (CVC 20001), evading arrest causing injury (CVC 2800.3), a 4th time repeat offender within a ten year period, and obtaining a DUI conviction after having had a prior felony DUI conviction (CVC 23550).
